The European Court of Justice (“ECJ”) has just released a decision that makes it clear that the changes to UK law in 2003 were not in accordance with European law.  It appears that Customs will now be forced to accept that a full VAT refund must be allowed when a building is used for both taxable business and non-business purposes.
